These Terms of Use ("Terms") govern your access to and use of the AllergenMaps mobile app and related services (collectively, the "Service"), operated by Allergen Maps LLC, an Indiana limited liability company ("AllergenMaps," "we," "us," or "our").
By creating an account or using the Service, you acknowledge that you have read, understood, and agree to be bound by these Terms and our Privacy Policy. If you do not agree, you must discontinue use of the Service.
AllergenMaps is an informational tool. You scan or enter a medication (by barcode or NDC), and the Service identifies potential allergen or sensitivity risks from a product’s inactive ingredients (excipients), checked against the allergen and exclusion profile you select.
Excipient categories that may be analyzed include gluten or wheat-derived ingredients, alpha-gal related materials, lactose or dairy, corn-derived ingredients, alcohols and solvents, dyes and color additives, and other excipient classes. The Service is an informational reference tool only.
All information provided by the Service is for informational and educational purposes only. The Service does not provide medical advice, diagnose conditions, recommend treatments, or replace professional medical consultation.
Always consult a licensed healthcare professional before making medication decisions. Healthcare professionals should rely on independent clinical judgment and official drug information sources.
AllergenMaps attempts to provide accurate, up-to-date information, but pharmaceutical manufacturing and ingredient sourcing involve complex supply chains.
The Service may classify a product using categories such as "No matches," "Verify," or "Contains." These represent interpretations of available information and do not constitute guarantees of safety or risk. Individual responses may vary.
AllergenMaps retains all rights, title, and interest in the Service and associated intellectual property, including its database structures, excipient risk classification systems, data compilation methods, software, and design. The Service is proprietary and may not be copied, replicated, reverse engineered, or used to develop competing services.
The Service contains confidential and proprietary information, including the allergen-to-excipient mapping methodology, which is a trade secret. By using the Service you agree not to disclose or publish such proprietary information without our written consent. This does not restrict you from reporting bugs or security issues, sharing general feedback, or disclosing information that is already public or required by law.
You are granted a limited, non-exclusive, non-transferable license to use the Service for personal, educational, or professional reference. This license does not permit commercial redistribution, database replication, or the creation of derivative or competing services.
Your use of the Service is governed by our Privacy Policy, incorporated by reference.
AllergenMaps is not a HIPAA Covered Entity or Business Associate, and the Service is a personal informational tool, not a medical record. The allergens and exclusions you select are stored on our servers so we can check medications against them; your medication list, history, reminders, and the names of people you manage are stored only on your device.
Use the Service for yourself and for those you are authorized to care for. Do not enter another person’s health information without their consent. Healthcare providers remain solely responsible for their own HIPAA obligations within their own systems.
The Service is provided "AS IS" and "AS AVAILABLE." AllergenMaps makes no warranties, express or implied, regarding the reliability, accuracy, or availability of the Service.
To the fullest extent permitted by law, AllergenMaps and its creators shall not be liable for any damages resulting from use of the Service, including medical decisions, allergic reactions, data inaccuracies, or service downtime. You are solely responsible for any third-party claims arising from your use of or reliance on the Service.
You agree to indemnify and hold harmless AllergenMaps, its creators, employees, and affiliates from any claims, damages, or liabilities arising from your misuse of the Service or violation of these Terms.
AllergenMaps may suspend or terminate access to the Service at any time for violations of these Terms or misuse of the platform.
We may update these Terms. For material changes (such as changes to liability, data practices, or intellectual property), we will provide reasonable advance notice by updating the "Last updated" date and posting a notice at least 30 days before the changes take effect. Continued use of the Service after the effective date constitutes acceptance of the revised Terms.
These Terms are governed by the laws of the State of Indiana, without regard to conflict-of-law provisions. Any legal action not subject to arbitration shall be brought exclusively in the state or federal courts located in Indiana.
Before initiating formal proceedings, the parties agree to attempt good-faith negotiation for at least 30 days by contacting legal@allergenmaps.org.
Except for claims seeking emergency injunctive relief or enforcement of intellectual property rights, any unresolved dispute shall be resolved by binding arbitration administered by the American Arbitration Association under its Consumer Arbitration Rules, with one arbitrator, in Indianapolis, Indiana.
Class Action Waiver. Any arbitration or proceeding shall be conducted solely on an individual basis. You may opt out of arbitration by sending written notice to legal@allergenmaps.org within 30 days of first using the Service.
If any provision of these Terms is found invalid or unenforceable, it shall be modified to the minimum extent necessary or severed, and the remaining provisions shall continue in full force and effect.
